Addressing the Governing Body: No person shall address the Governing Body during a Governing Body Meeting, unless they have notified the City Clerk at (785)368-3940 or by email at cclerk@topeka.org by 5:00 P.M. on the day of any Governing Body Meeting or sign up to speak at the meeting by 6:00 P.M. This limitation shall not apply to items added during the course of a meeting. The Governing Body does not take action with respect to any subject not on the agenda unless added to the agenda by a two-thirds vote of the Governing Body.
 
Persons addressing the Governing Body will be limited to four (4) consecutive minutes on a particular agenda item. Debate, question/answer dialogue or discussion between Governing Body members will not be counted towards the four (4) minute time limitation. The Chair may extend time with the unanimous consent of the Governing Body or by an affirmative vote of five (5) Governing Body members may extend the four (4) minute limitation. The requirement to notify the City Clerk will not apply towards public hearings required by State and Federal law.

BOARD APPOINTMENT recommending the reappointment of Shaye Downing to the Topeka Housing Authority Board of Commissioners to fill a term ending January 1, 2022. (Council District No. 7)

B.Board Appointment - Topeka Public Building Commission

 

BOARD APPOINTMENT recommending the appointment of Frank Burnam to the Topeka Public Building Commission for a term ending November 15, 2021.  (Council District No. 4)

A.Resolution - Designating Depositories


A RESOLUTION introduced by City Manager Brent Trout, naming banks and savings institutions that are designated as depositories for all City of Topeka accounts and authorizing signatories and rescinding City of Topeka Resolution No. 8849.

B.Resolution - State of Kansas Municipal Investment Pool


A RESOLUTION introduced by City Manager Brent Trout, concerning the City of Topeka's participation in the State of Kansas Municipal Investment Pool and rescinding City of Topeka Resolution No. 8850.

C.Settlement Proposal - Stephen Thompson

 

APPROVAL of a proposed settlement agreement and release of all potential claims, including EEOC Charge No. 563-2017-01687 for payment of $25,000.

 

(Approval would allow for settlement of all potential claims against the City without litigation.)

A.Resolution - Doorstep, Inc. (CU17/1)

 

RESOLUTION introduced by City Manager Brent Trout, in accordance with Section 18.60.010 of the Topeka Municipal Code, amending a Conditional Use Permit (SP60/2) that allowed specifically for the sales of orthopedic appliances to allow “retail sales that is subordinate and in association with the principal use of the office building” on property located at 1119 SW 10th Avenue and presently zoned “O&I-2” Office and Institutional District, all being within the City of Topeka, Shawnee County, Kansas.  (CU17/1) (Council District No. 1)

 

Voting Option Requirements: (1)Approve Planning Commission's recommendation 6 votes required (2) Reject or Amend Planning Commission's recommendation 7 votes required; or (3) Remand back to Planning Commission 6 votes required

 

(Approval would allow Doorstep, Inc. to use a 1,768 square foot portion of the building for its retail thrift store.)

B.Ordinance - Mr. David Bussard (Z17/04)

 

ORDINANCE introduced by City Manager Brent Trout, amending the "District Map" referred to and made a part of the Zoning Ordinance by Section 18.50.050 of the Topeka Municipal Code, by providing for certain changes in zoning on property located at 2655 SW Wanamaker Road FROM "O&I-1" Office and Institutional District TO "C-2" Commercial District. (Z17/04) (Council District No.8)

 

Voting Option Requirements: (1)Approve Planning Commission's recommendation 6 votes required (2) Reject or Amend Planning Commission's recommendation 7 votes required; or (3) Remand back to Planning Commission 6 votes required

 

(Approval would provide for the expansion of the existing office building and allow for a larger business ground sign at the southeast corner of the site to accommodate an increased number of tenant office spaces. The sign will measure approximately 15 feet in height and 110 feet in area). 

C.Ordinance - Franklin E. Webb (Z17/5)

 

ORDINANCE introduced by City Manager Brent Trout, amending the "District Map" referred to and made a part of the Zoning Ordinances by Section 18.50.050 of the Topeka Municipal Code, by providing for certain changes in zoning on property located at 5127 SW Wanamaker Road from “RR-1” Residential Reserve District and “C-2” Commercial District ALL TO “R-1” Single-Family Dwelling District. (Z17/5) (Council District No. 7)

 

Voting Option Requirements: (1)Approve Planning Commission's recommendation 6 votes required (2) Reject or Amend Planning Commission's recommendation 7 votes required; or (3) Remand back to Planning Commission 6 votes required

 

(Approval would allow the property owner to construct one new, single-family residence on the 38-acre parcel.)

D.Labor Agreement - AFSCME - Development Services and Planning

 

APPROVAL of a three year labor agreement between the City of Topeka and Local 1294 Missouri/Kansas State Council 61, American Federation of State, County and Municipal Employees (AFSCME), AFL-CIO.

 

Voting Requirement: Majority vote of the Governing Body (6).

 

(Approval would provide guidelines for management and employees in the bargaining unit. Term of agreement is from 2017 through 2019.) 

E.Set the Public Hearing Date - 2017 Budget Amendment


AUTHORIZING a public hearing for December 5, 2017, for the purpose of hearing and answering objections of taxpayers relating to the proposed amendments to the 2017 Operating Budget.

 

Voting Requirement: Majority vote of the Governing Body (6).


(Approval authorizes publication of the Notice of Public Hearing for December 5, 2017, in the November 20, 2017, edition of the Topeka Metro Newspaper.)  

F.Public Hearing and Ordinance - Wheatfield Village Project Plan

 

PUBLIC HEARING and ORDINANCE introduced by City Manager Brent Trout, adopting a Redevelopment Project Plan for the Wheatfield Village Redevelopment District pursuant to K.S.A. 12-1770 et seq., as amended.

 

Voting Requirement: Two-thirds vote of the Governing Body (7).

 

(Approval would adopt the Project Plan for redevelopment of the northwest corner of SW 29th Street and SW Fairlawn Road - Wheatfield Village.)

G.Ordinance - Wheatfield Village Planned Unit Development Master Plan (PUD 17/02)

 

ORDINANCE introduced by City Manager Brent Trout, amending the “District Map” referred to and made a part of the Zoning Ordinances by Section 18.50.050 of the Topeka Municipal Code, by providing for certain changes in zoning on property located at the northwest corner of SW 29th Street and SW Fairlawn Road in the City of Topeka, Kansas, FROM “C-4” Commercial District TO “PUD” Planned Unit Development District (C-4 and M-3 use groups). (PUD 17/02) (Council District No.8)

 

Voting Option Requirements: (1)Approve Planning Commission's recommendation 6 votes required (2) Reject or Amend Planning Commission's recommendation 7 votes required; or (3) Remand back to Planning Commission 6 votes required

 

(Approval would allow for a mixed-use re-development of a 14.7 acre property that includes restaurants, movie theater, hotel and a multi-family apartment complex.)

H.Ordinance - Wheatfield Village Community Improvement District (CID)

 

ORDINANCE introduced by City Manager Brent Trout, establishing a Community Improvement District for the Wheatfield Village District at 29th and Southwest Fairlawn Road and levying a CID sales tax of two percent (2%) within the CID.

 

Voting Requirement: Majority vote of the Governing Body (6).

 

(Approval would establish a community improvement district at the northwest corner of SW 29th Street and SW Fairlawn Road and impose a 2% retailers sales tax on retail sales or services within the district.)

A.Discussion - Downtown Parking Plan Recommendations

 

DISCUSSION related to the Downtown Parking Master Plan recommendations.
