ORDINANCE introduced by City Manager Dr. Robert Perez amending the “District Map” referred to and made a part of the Zoning Ordinances by Section 18.50.050 of the Topeka Municipal Code by approving a major amendment to the Planned Unit Development for Paradise Providence Place to allow a Crisis Center Type II in association with and accessory to the principal use of Religious Assembly on property located at 2401 SE 11th Street.  (PUD 24/16) (Council District No. 3)

 

Voting Option Requirements: (1) Approve Planning Commission's recommendation, 6 votes are required of the Governing Body (2) Reject or Amend Planning Commission's recommendation, 7 votes are required of the Governing Body; or (3) Remand back to Planning Commission, 6 votes are required of the Governing Body.

 

(Approval will allow boarding and lodging for a maximum of eight residents; plus an additional 20 beds during inclement weather, and limited to October 16th through April 15th within any year, and only in coordination with and at the request of the City of Topeka.)

 

VOTING REQUIREMENTS:

Governing Body Members have the following voting options:

 

  1. Approve the Planning Commission’s recommendation by adopting the ordinance. A minimum of 6 votes are required of the Governing Body.
  2. Amend the Planning Commission’s recommendation by amending the ordinance. A minimum of 7 votes are required is required of the Governing Body.
  3. Refuse to approve the Planning Commission’s recommendation by rejecting the ordinance. A minimum of 7 votes are required of the Governing Body.
  4. Remand to the Planning Commission for further consideration, with a statement specifying the basis for the governing body’s failure to approve or disapprove. A minimum of 6 votes are required of the Governing Body.
POLICY ISSUE:

Whether to adopt the Planning Commission's recommendation to rezone the property

STAFF RECOMMENDATION:
Staff recommends the Governing Body move to adopt the ordinance approving the rezone.
BACKGROUND:

PUD24/16 will allow a Crisis Center Type II within the existing building located at 2401 SE 11th Street currently used for religious assembly and related uses.  The Crisis Center Type II will provide the following uses to the community and neighborhood: 1.) Temporary board and lodging for a maximum of eight residents. 2.) Seasonal emergency overnight homeless shelter for up to 20 beds October 16th - April 15th during inclement weather and when requested by the City of Topeka.    The existing clothing and food pantry is allowed as an accessory use to the religious assembly.  

 

The applicant conducted a Neighborhood Information Meeting on November 21, 2024.  No one other than planning staff and the applicant attended the meeting.

 

The Planning Commission recommended approval by a vote of 7-0-1 on December 16, 2024.  Staff recommends approval per the attached staff report.
