RESOLUTION introduced by City Manager Brent Trout to demolish the White Lakes Mall structure.

 

Voting Requirement: At least six (6) votes of the Governing Body is required.

 

(Approval would direct the City Manager to begin the process to demolish the White Lakes Mall located at 3600 SW Topeka Boulevard.)

POLICY ISSUE:

Whether to direct the City Manager to demolish the White Lakes Mall.

STAFF RECOMMENDATION:

Staff recommends the Governing Body move to approve the resolution.

BACKGROUND:

The White Lakes Mall has been the subject of numerous property maintenance code violations in the last five years as a consequence of failure of the owner, KDL, Inc. to maintain the vacant structure.  

 

In December, 2020, a structure fire damaged the Mall to such as extent that, on July 2, 2021, the City's administrative hearing officer ordered the property owner to demolish the structure.

 

As the property owner has not demolished the structure, the City may do so and seek reimbursement from the property owner.  If the owner fails to pay the cost, the City may impose a lien on the property.  Should the property be sold, the lien would be paid.

BUDGETARY IMPACT:

Approximately $2.5 million dollars
