Security Guard License Appeal submitted by Christopher Ortega.

 

Voting Requirement:  At least six (6) votes of the Governing Body is required.

 

(Approval of the denial of the appeal will affirm the Topeka Police Department's decision to not renew Mr. Ortega's security guard license.)

POLICY ISSUE:

Whether the facts supporting the denial of the license application are correct (i.e. was the applicant convicted of unlawful discharge of a firearm within 10 years prior to the license renewal application).

STAFF RECOMMENDATION:
Denial pursuant to Topeka Municipal Code.
BACKGROUND:

With the exception of years 2010 and 2011, Mr. Ortega has been licensed as a security guard with the City of Topeka since 2008.  When he applied to renew his license, the Police Department denied his application based on the fact that  Mr. Ortega pled no contest in municipal court to unlawful discharge of a firearm on September 26, 2017.  Conviction of a crime involving the use of a firearm is one of the grounds for denial of a license.  Mr. Ortega’s appeal request indicates that his firearm misfired while attempting to protect family members.  He is employed by Securitas.

BUDGETARY IMPACT:

There is no budgetary impact to the City.
