ORDINANCE introduced by City Manager Brent Trout amending the “District Map” referred to and made a part of the Zoning Ordinances by Section 18.50.050 of the Topeka Municipal Code, approving a major amendment to the Planned Unit Development (PUD) Master Plan for Wanamaker West on a 2.1 acre property located approximately 500 ft. west of the intersection of SW Wanamaker Road and SW 30th Terrace along the south side of SW 30th Terrace in order to add the use of “Indoor Recreation Type II” to the allowed (C-2 and I-1 ) uses indicated in the PUD Master Plan all being within the City of Topeka, Shawnee County, Kansas  (PUD19/3A) (Council District No. 8)

 

Voting Option Requirements: (1) Approve Planning Commission's recommendation, 6 votes is required of the Governing Body (2) Reject or Amend Planning Commission's recommendation, 7 votes is required of the Governing Body; or (3) Remand back to Planning Commission, 6 votes is required of the Governing Body.

 

(Approval will allow development of an indoor simulated golf recreation and entertainment facility within a commercially zoned area.)

VOTING REQUIREMENTS:

Governing Body Options:

 

  1. Approve the Planning Commission’s recommendation. A minimum of 6 votes of the Governing Body is required.
  2. Amend or Reject the Planning Commission’s recommendation. A minimum of 7 votes of the Governing Body is required.
  3. Remand to the Planning Commission for further consideration, with a statement specifying the basis for the governing body’s failure to approve or disapprove.  A minimum of 6 votes of the Governing Body is required.
POLICY ISSUE:

The primary issue of the proposed amendment to the PUD Master Plan relates to the suitability of the property for the proposed indoor simulated golf venue.  Approval of the amended PUD master plan is recommended in part because:     

 

  • Many "C-2" Commercial uses allowed in the PUD are not likely to be commercially viable because the property is on a dead-end street and not readily visible from Wanamaker Road. 
  • The proposed recreation use will be indoors and at a scale that will be compatible with uses already allowed under the current C-2 zoning.
  • No more traffic would be generated than what is already allowed under the current zoning.  
STAFF RECOMMENDATION:

Staff recommends the Governing Body move to adopt the ordinance.

BACKGROUND:

PUD19/3A is a request to amend the PUD Master Plan by adding “Indoor Recreation Facility Type II” to allow development of the property as an indoor simulated golf venue.  The current PUD zoning  allows “C-2” Commercial uses plus self-storage facilities and building and contractor offices/yards.  "Indoor Recreation Type II" is only allowed by conditional use permit in C-2 zoning.   

 

The applicant and owner conducted a Neighborhood Information Meeting on Monday, July 27, 2020.  The neighboring property owner attending the meeting expressed concern about traffic from the adjacent car wash and the potential for the proposed use to exacerbate traffic. The proposed use is expected to generate no more traffic than uses already allowed under the current PUD.   

 

The Topeka Planning Commission recommended approval on August 17, 2020 and the Planning Department recommends approval as indicated in the attached staff report.  

BUDGETARY IMPACT:
There is no budgetary impact to the City.
