AN ORDINANCE introduced by Interim City Manager Doug Gerber, concerning seat belt fines, amending City of Topeka Code Section 10.15.020 and repealing original section and creating Section 10.20.020.
Voting Requirement: Majority vote of the Governing Body (6 votes).
(Approval would increase the seat belt fine from $10 to $30 as mandated by State Law effective July 1, 2017.) | VOTING REQUIREMENTS: | | POLICY ISSUE: | Whether to follow the new state law that increases the seat belt fine from $10 to $30. | STAFF RECOMMENDATION: | Staff recommends the Governing Body move to adopt the ordinance. | BACKGROUND: | With certain exceptions, state law requires that individuals over the age of 14 wear a seat belt. State law establishes a fine of $10 for individuals over the age of 18. City ordinance follows this state law and imposes a fine of $10.
However, a new state law, Senate Bill 89 - which becomes effective July 1, 2017, increases the fine for seat belt violations from the current fine of $10 to $30. State law requires that cities amend their ordinances to conform to state law.
