PUBLIC HEARING AND ORDINANCE introduced by Interim City Manager Doug Gerber establishing a business improvement district to be known as the Topeka Tourism Business Improvement District (“TTBID”) and creating Topeka Municipal Code Chapter 3.65 addressing services, financing and establishment of a district advisory board in accordance with K.S.A. 12-1782 et seq.

 

(Approval would establish a business improvement district to be known as the Topeka Tourism Business Improvement District; define the services to be provided; impose a service fee on all hotels and establish a district advisory board.)

POLICY ISSUE:
Whether to establish a tourism business improvement district.
STAFF RECOMMENDATION:

Staff recommends that the public hearing be held and that, at its conclusion, the ordinance establishing the tourism business improvement district be adopted.

BACKGROUND:

On March 7, 2017, the district planning committee submitted a report to the governing body recommending that a tourism business improvement district be established. On March 14, 2017, the governing body approved a resolution indicating its intent to establish the Topeka Tourism Business Improvement District pending a public hearing to be held on May 9, 2017. 

 

The ordinance proposed: (1) establishes the district, with boundaries coterminous with the City boundaries; (2) establishes a sunset of December 31, 2027; (3) describes the services to be provided, including design plans for the downtown plaza; (4) provides for a service fee that will be imposed on hotels -- the fee will be established after the advisory board submits a budget to the governing body (due by May 15, 2017) as required by KSA 12-1790; and (5) establishes an advisory board whose initial members will be appointed by the Topeka Lodging Association, with members nominated by the Lodging Association for consideration by the Mayor after January 1, 2018.

BUDGETARY IMPACT:

None.  However, after the district advisory board provides a proposed budget (which, by law, is due by May 15 of each year) the governing body will impose a service fee, by ordinance, on all hotels.  The fee will be remitted to the City monthly, with the finance department retaining two percent (2%) to cover administrative costs.
