ORDINANCE introduced by Interim City Manager Douglas Gerber annexing land to the City of Topeka, Kansas, in accordance with K.S.A. 12-520, located at 3636 SE 6th Avenue, within unincorporated Shawnee County, Kansas and adjacent to the City of Topeka corporate limits, and said land being annexed for all City purposes.  (A17/2) (Council District No. 3)

 

(Approval would allow annexation of a 12-acre tract to accommodate relocation of wastewater and stormwater facilities for Reser's Fine Foods and assign the tract to Council District No. 3.)

POLICY ISSUE:
Resers Fine Foods has requested annexation of a 12-acre tract at 3636 SE 6th Avenue that is additional land for the previously approved food manufacturing and distribution use adjacent to the property to the east. The request simply expands the footprint of the site in order to relocate their stormwater and wasterwater facilities that will accommodate better truck circulation. The request does not add any additional development under the previously approved PUD. The annexation is consistent with the previously amended Land Use and Growth Management Plan.
STAFF RECOMMENDATION:
Staff recommends the Governing Body move to adopt the ordinance.
BACKGROUND:

The property lies within Tier 3 of the Urban Growth Area (UGA) as delineated in the updated Land Use and Growth Management Plan 2040 (LUGMP 2040).

 

Generally speaking, Tier 3 areas of the UGA are not ready for urbanization because investments haven’t been made in all five of Topeka’s urban services (fire, police, water, sewer and streets). However, investments in infrastructure and services have been made in this area. There is City water and sewer adjacent to the property, the police department is currently serving the area directly to the south, there is a fire station less than 1 mile from the subject property and SE 6th Avenue/Street has been improved to a five-lane urban arterial. All five urban services are available to this property.

 

The subject property and the area around it lie within Topeka’s Urban Growth Area (UGA), which means there is an expectation that the area will urbanize.  As noted above, the community has made significant investments in infrastructure and services to support the urbanization of this area.

 

The Planning Commission finds the annexation consistent with the City's Land Use and Growth Management Plan.

BUDGETARY IMPACT:
All essential public utilities, services and facilities are presently available and will not be overburdened by the annexation.
