AN ORDINANCE introduced by Interim City Manager Doug Gerber authorizing initiation of condemnation proceedings to acquire a temporary easement and permanent easements for a sanitary sewer pump station (Improvement Project No. T-291011.00).

(Approval would authorize the City Attorney to initiate condemnation proceedings in district court  to secure a temporary and permanent easements for construction of a sanitary sewer pump station at NW Williams and NW Eugene Street.)

POLICY ISSUE:

Approval would authorize condemnation to secure a temporary and permanent easements for construction of a sanitary sewer pump station at NW Williams and NW Eugene Street.

STAFF RECOMMENDATION:
Staff recommends the Governing Body move to adopt the ordinance.
BACKGROUND:

This ordinance will serve as the companion document to the proposed resolution to be considered on the April 11, 2017 Council agenda.  The City Engineer has determined it is necessary to secure temporary and permanent easements by condemnation in order to construct a sanitary sewer pump station on vacant property owned by the Topeka Housing Authority (THA) located at NW Williams and NW Eugene Street. This new pump station will replace a failing pump station in the vicinity.

 

In addition to THA's interest,  the U.S. Department of Housing and Urban Development (HUD) also has a legal interest in the property by virtue of its grants to THA.  Should the ordinance pass, the City Attorney will file a petition in district court naming both THA and HUD as parties.  The Court will appoint three appraisers who will determine the compensation due for those property interests.  Upon payment of the compensation to the Court, the City will acquire a temporary easement, a permanent public improvement easement and a permanent ingress-egress easement totaling approximately four acres.

BUDGETARY IMPACT:
It will cost $1,410 to secure the property for the project.
