RESOLUTION introduced by Interim City Manager Doug Gerber, authorizing the City Engineer to conduct a survey prior to initiating condemnation proceedings to acquire a temporary easement and permanent easements for a sanitary sewer pump station (Improvement Project No. T-291011.00).

 

 (Approval would authorize the City Engineer to perform a survey for the purpose of determining the necessity of condemning private property interests for construction of Pump Station No. 12 on vacant property located at NW Williams and NW Eugene Street.)

POLICY ISSUE:
Whether to authorize the City Engineer to perform the survey.
STAFF RECOMMENDATION:

Staff recommends the Governing Body move to approve the resolution.

BACKGROUND:

Kansas law allows cities to condemn private property for public purposes such as construction of pump stations provided the owner is compensated.  Prior to initiation of condemnation proceedings, the governing body must enact a resolution authorizing the City Engineer to perform a survey and identify those property interests that are necessary for the public improvement project. If the resolution is approved, the City Engineer will file with the Clerk a description of the property interests that need to be acquired through condemnation.

BUDGETARY IMPACT:
There would be no budgetary impact to the City.
