DISCUSSION concerning carrying of firearms in City-owned buildings.
(Discussion to consider repealing the ineffective ban on firearms in City-owned buildings as set forth in Topeka Municipal Code Section 9.40.005 and other consequences of the 2016 amendments to the Personal and Family Protection Act.) | POLICY ISSUE: | TMC 9.40.005 must be repealed to comply with state statutes. Other potential policy issues concerning firearms in City buildings will be discussed. | STAFF RECOMMENDATION: | Discussion item only. The ordinance will be presented for consideration at the May 2, 2017 Governing Body meeting. | BACKGROUND: | Amendments to the Personal and Family Protection Act allow conceal carry of handguns in city buildings unless the building (1) is subject to an exemption adopted by the governing body (current exempt buildings are Municipal Building, Holliday Building and Gage Park Zoo) or (2) has adequate security measures (i.e., armed personnel and metal detectors currently present at the Law Enforcement Center and Municipal Court). The current ordinance that simply names buildings in which firearms cannot be carried conflicts with controlling state law and should be repealed.
| BUDGETARY IMPACT: | There is no budgetary impact to the City by the repeal TMC 9.40.005; however, if the policy decision is made to adopt additional security measures there will be associated costs (See Exhibit A.) | SOURCE OF FUNDING: | Not applicable. |
