DENIAL of claim filed by Bettis Asphalt seeking $88,176 in damages for increased costs and other damages incurred in connection with work performed at the Kanza Education and Science Park. | POLICY ISSUE: | The Governing Body should deny the claim based on the fact the City's conduct did not cause the damages alleged by Bettis. | STAFF RECOMMENDATION: | Staff recommends the Governing Body move to deny the claim in the amount of $88,176. | BACKGROUND: | The City hired Bettis Asphalt to complete City Project No. T-601030.00. While working on the project, Bettis hit a City water line that released water onto the project site. The escaped water damaged equipment and materials and required modifications to work schedules. | BUDGETARY IMPACT: | If the claim is approved in the approximate amount of $88,176, then it would be paid from the Combined Utilities Fund. | SOURCE OF FUNDING: | Combined Utilities Fund |
