AN ORDINANCE introduced by Councilmember Elaine Schwartz concerning the prohibition of electronic cigarettes, amending City of Topeka Code Sections 8.20.020, 8.20.070 and 8.20.080 and repealing original sections.    

 

(Approval would add electronic cigarettes to the prohibition of smoking in enclosed public places.)

POLICY ISSUE:
Approval would prohibit electronic cigarettes in enclosed public places, similar to the current prohibition of smoking.  In order to give citizens and businesses time to comply, the effective date would be November 1, 2015.
STAFF RECOMMENDATION:
Staff makes no recommendation.
BACKGROUND:

Including electronic cigarettes in the City's current smoking prohibition follows the lead of other Kansas cities: Olathe, Overland Park, McPherson, and Kansas City which added e-cigarettes to their anti-smoking ordinances. The amendments  to the ordinance include the following:

 

(1) Define ‘electronic cigarette’;

(2) Redefine ‘smoking’ to include electronic cigarettes;

(3) Create an exemption – similar to the exemption for tobacco stores - for Retail businesses that sell electronic cigarettes (e.g. ‘vape’ shops); and

(4) Require businesses to post signs that prohibit smoking, including electronic cigarettes.

BUDGETARY IMPACT:
There would be no budgetary impact to the City.
